This website is managed and operated by CircLuxe Inc. Gallery Rare Business Division (Hereinafter referred to as “Gallery Rare”) and through this Website Policy, Gallery Rare shall provide the terms of use with respect to the current services provided by Gallery Rare, and other services newly provided in the future. (Hereinafter collectively referred to as the “Services”) as follows.

Users who use the Services shall be expected to follow the terms of use and services hereinafter defined as below:

  • Wholesale Offer List
  • Proxy Buying
  • Proxy Auction Bidding

Ⅰ - Terms of Use Application

  1. The Terms of Use shall provide the conditions relevant to the use of the Services and apply to all users who use the Services.
  2. Gallery Rare will post relevant matters to users on the website or through other online communication methods. (Hereinafter referred to as the “Notices”). In the event that the Notices are contradictory to or infringe the Website Policy, the Notices will be given priority.
  3. Gallery Rare shall deem users to have consented to the conditions of the Terms of Use as of the time when the user applies for the Services.
  4. The user shall provide obligatory customer information through the membership registration to apply for the Services.

Ⅱ - Terms of Use Amendment

  1. Gallery Rare may amend this agreement without the prior consent of users to operate and provide services.
  2. In the event that Gallery Rare is required to amend all or a section of the Website Policy, Gallery Rare shall set an effective date in advance and announce the amendment on the Website 14 days before the effective date.

Ⅲ - Notices

  1. Notices from Gallery Rare to users shall be provided by the means judged appropriate by Gallery Rare, such as in writing, posting on the Website, or other online communication methods.
  2. In the case that a notice is issued by posting on the Website, the relevant notice shall come into effect as of the time of publication.
  3. In the case that a notice is issued by other online communication methods, the relevant notice shall come into effect one business day after the completion of transmission.

    Ⅳ - Use of Service Termination

    1. Users may terminate the use of the Services at any time.
    2. In the event a user chooses to terminate the use of the Services, the user shall apply through the method specified by Gallery Rare.

    Ⅴ -  Provision of Services Termination

    1. Gallery Rare may terminate the provision of the Services without prior notice or approval from the user.
    2. Gallery Rare shall not be liable for any damages, loss, or disadvantages incurred by the user directly or indirectly due to terminating the provision of services.

      Ⅵ - Consultations

      1. Matters not provided in the Website Policy or any doubts arising in the interpretation of the provisions of the terms of use shall be settled upon bona fide consultations between the user and Gallery Rare.

      Ⅶ - Governing Law and Jurisdiction

      1. The Services shall be governed by and construed in accordance with the laws of Japan.
      2. Any disputes arising from or in relation to the terms of use shall be subject to the exclusive jurisdiction of the Osaka District Court or Osaka Summary Court as the court of first instance.
