Website Policy

This website is operated by Gallery Rare Ltd.　(hereinafter referred to as “Gallery Rare”)
Gallery Rare shall provide terms of use with respect to the Gallery Rare Services it operates on the Internet and service incidental thereto that Gallery Rare will provide newly in the future (hereinafter collectively referred to as the “Services”) as follows.

Customers who use the Services shall be expected to follow the Terms of Use and the Services are hereinafter defined as below:

  • The Wholesale List
  • The Virtual Consignment
  • Auction Intermediate Service

Ⅰ- Application of the Terms of Use

  1. The Terms of Use shall provide rules relevant to use of the Services, and be applicable to all customers who use the Services, together with the Notes stated later.
  2. Matters provided to customers by the means judged appropriate by Gallery Rare, such as posting on the website of Gallery Rare or electromagnetic means (hereinafter referred to as the “Matters for Notification”) shall compose a part of the Terms of Use. If there are provisions of the Matters for Notification that are contradictory to or infringing the Terms of Use, the Matters for Notification shall prevail.
  3. Gallery Rare shall deem the customer to have consented to the contents of the Terms of Use as of the time when the customer applies for the Services.
  4. The customer shall provide obligatory customer information from the Contact Form in order to apply for the Services.

Ⅱ- Amendment to the Terms of Use

  1. In terms of operating the Services, Gallery Rare may amend this agreement without the consent of customer.
  2. In case that Gallery Rare may amend all or part of the Website Policy, Gallery Rare shall set the effective date in advance and announce on the Website prior 14 days.

Ⅲ - Notices

  1. Notices from Gallery Rare to customers shall be provided by the means judged appropriate by Gallery Rare, such as in writing, posting on the website of Gallery Rare, or other electromagnetic means, etc., unless otherwise provided.
  2. When a notice as referred to in the preceding paragraph is issued by posting on the website of Gallery Rare, the relevant notice shall come into effect as of the time when it is posted on the website.
  3. When a notice as referred to in Paragraph 1 is issued in writing or by electromagnetic means, the relevant notice shall be deemed to have been made as of the time when one business day has elapsed from transmission.

    Ⅳ - Termination of Use of Services

    1. Customers may terminate the use of the Services at any time.
    2. When a customer is to terminate use of the Services, the customer shall apply to Gallery Rare by the method prescribed by Gallery Rare.

    Ⅴ -  Termination of Provision of Services

    1. Gallery Rare may terminate provision of the Services without prior notice to or approval from customer.
    2. Gallery Rare shall assume absolutely no liability whatsoever for any damage, loss or disadvantage incurred by customers directly or indirectly as a result of the preceding paragraph.

      Ⅵ - Consultations

      1. Matters not provided in the Terms of Use or any doubts arising in the interpretation of the provisions of the Terms of Use shall be settled upon bona fide consultations between the customer and Gallery Rare.

      Ⅶ -  Governing Law and Jurisdiction

      1. The Services shall be governed by and construed in accordance with the laws of Japan.
      2. Any disputes arising from or in relation to use of the Services shall be subject to the exclusive jurisdiction of Osaka District Court or Osaka Summary Court as court of first instance.
